t is previously specified that the present conditions exclusively govern the sales, by enograph.fr of all the products present on its site.

Article 1 – Prices

The prices of our products are indicated in euros all taxes included excluding shipping costs. All orders regardless of their origin are payable in euros.

In case of order to a country other than metropolitan France you are the importer of the product concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of ENOGRAPH. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies of your country. We advise you to inquire about these aspects with your local authorities.

ENOGRAPH reserves the right to change prices at any time but the products will be billed based on the rates in effect at the time of your order confirmation.

The products remain the property of ENOGRAPH until full payment of the price. We remind you that when you take physical possession of the products ordered, the risk of loss or damage to products will be transferred.

ENOGRAPH is not intended to sell to professionals, the products and services sold by ENOGRAPH are reserved for individuals.

 

Article 2 – Order

The contractual information is presented in French and will be the subject of a confirmation containing this contractual information at the latest at the time of your order validation.

The customer declares to be at least eighteen (18) years old and to have the legal capacity or to hold a parental authorization allowing him to make an order

 

Article 3 – Validation of your order

You declare to have read and accepted these Terms of Sale before placing your order. Validation of your order is therefore acceptance of these Terms of Sale.

The order will be considered accepted at the time of the confirmation of the order by e-mail (acknowledgment of receipt confirming the order and filled with all the elements of the contract).

ENOGRAPH reserves the right not to confirm an order for any reason whatsoever. The refusal of order will be served by e-mail.

 

Article 4 – Availability

ENOGRAPH is a retailer and is not intended to sell in large quantities the products offered. As a result, ENOGRAPH reserves the right to refuse orders for the same product in large quantities and from 3 identical items. It is advisable to contact us by email at contact@enograph.fr or by telephone at 01 40 27 94 08 for orders in large quantity.

Our product offers are valid as long as they are visible on the site, while stocks last. In the event of unavailability of product after placing your order, we will notify you by email. Your order will be automatically canceled and no bank debit will be made.

 

Article 5 – Delivery

The products are delivered to the delivery address that you indicated during the order process within the time specified on the order confirmation page by the customer.

The delivery time corresponds to:

the shipping time indicated on the website to which is added (48 hours after receipt of payment)
the processing and routing time (delivery times of our service providers, given for information only)

In case of delay of shipment, an email will be sent to inform you of a possible consequence on the delivery time which has been indicated to you. In case of late delivery, we will offer you by mail a new delivery time.

We remind you that when you (or a third party designated by you) physically take possession of the products ordered, the risk of loss or damage to the products will be transferred.

In case of absence of the recipient at the time of delivery, the carrier will deliver a notice to the delivery address indicated by the customer. The products must be removed at the address and in the manner indicated by the carrier.

In case of force majeure, whatever it is, beyond our control (external event, unpredictable and irresistible), the seller will be released from any obligation towards the buyer.

You must notify the carrier and ENOGRAPH of any reservations about the delivered product (for example: damaged package, already open …).

For delivery outside France, incoterm is DAP (delivered at place)

Customs and import taxes
Any customs and import taxes are the responsibility of the buyers. We are not responsible for delays caused by customs.

 

Article 6 – Payment

We remind you that the fact of validating your order implies the obligation to your charge to pay the indicated price. The payment of your purchases can be made according to the means of payment accepted by ENOGRAPH indicated in the heading “Means of payment”.

The debit of the card is made at the time of the order.

The payment of purchases is made by credit card (Visa, MasterCard), by bank transfers from the bank Société Générale.

 

Article 7 – Security

Our site is the subject of a security system.

We have adopted the encryption process so that the information you provide to us is protected when it is transmitted to our payment processing center.

 

Article 8 – Right of withdrawal

n accordance with the legal provisions in force, you have a period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay a penalty. After communicating your decision to exercise your right of withdrawal within this 14-day period, you have another period of 14 days to return the product (s) concerned by the retraction.

In case of exercise of the right of withdrawal, only the price of the product (s) purchased and the shipping costs will be refunded, the return costs are your responsibility.

Returns are to be made in their original condition allowing their remarketing in new condition.

You can exercise your right of withdrawal by an email expressing your desire to retract without any ambiguity, and mentioning the order concerned by this retraction.

Once the declaration of retraction sent to ENOGRAPH no later than 14 days after receipt of your order, you must return the product (s) concerned by sending it back to the ENOGRAPH store, within a reasonable time and, at the latest, in 14 days from the sending of the declaration of withdrawal to ENOGRAPH.

In case of exercise of the right of withdrawal, ENOGRAPH will refund the amounts paid (including delivery charges) no later than 14 days from the date on which ENOGRAPH is informed of your withdrawal decision and according to the same means of payment than those used for the order (except your express agreement for a refund by another means of payment). This refund date may be deferred until the product is recovered or until you have provided proof of shipment of the product, whichever comes first. ENOGRAPH is not obliged to refund additional costs if you have expressly chosen a more expensive method of delivery than the standard delivery method offered on enograph.fr.

No cash delivery will be accepted for any reason.

 

Article 9 – Guarantees

Delivered products are systematically checked by ENOGRAPH before shipment.

In accordance with the provisions of the legal guarantees of conformity and latent defects, we refund or exchange the products apparently defective or not corresponding to your order.

The products must be returned to us or returned to the store in the state where you received them in a packaging allowing the transport in good conditions. Shipping costs will be reimbursed based on the invoice price and return shipping costs will be reimbursed upon presentation of receipts.

 

Article 10 – Intellectual property

All texts, comments and presentations represented on the ENOGRAPH website are strictly reserved under copyright and intellectual property rights and for the whole world. Any reproduction or total or partial representation of the sites of the ENOGRAPH or of all or part of the elements found on the sites of the ENOGRAPH is strictly prohibited.

ENOGRAPH does not edit on demand. All posters are published by authorized houses having received the necessary authorizations from the rights holders or their legal representatives.

As such and in accordance with the provisions of the Code of Intellectual Property, only the use for private use subject to different or even more restrictive provisions of the Code of Intellectual Property is permitted.

 

Article 11 – Liability

The proposed products comply with the French legislation in force. The responsibility of ENOGRAPH can not be committed in case of non-compliance with the legislation of the country where the product is delivered (for example in case of prohibition of a title or a product). It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you intend to order.

Article 12 – Applicable Law – Disputes – Claims Processing

Applicable law: This contract is subject to French law. The language of this contract is French. In case of dispute the French courts will be competent.

Claims processing: For any claim you can contact customer service. All you have to do is write us online at contact@enograph.fr, indicating your last name, first name, e-mail address and if possible your customer reference.

 

Article 13 – Personnal datas

Personal information and personal data about you are necessary for the management of your order and our commercial relations. They can be passed on to companies that contribute to these relationships such as those responsible for the execution of services and orders for their management, execution, processing and payment.
